IN EXERCISE of the powers conferred by section 27 (k) of the Law Society of Kenya Act, the Council, with the approval of the Society by special resolution makes the following Regula• tions : —-

(AMENDMENT) REGULATIONS, 1995

  1. These Regulations may be cited as Law Society Of Kenya (General) (Amendment) Regulations, 1995.
  2. The Law Society of Kenya (General) Regulations are amended—

(a) by renumbering the existing paragraph 2 as paragraph

  • Where a member dies testate, the administrator or administrators shall deal with his firm as may be stated in his will; but incase of intestacy, the Council of the Society shall give such directions cr instructions to the administrator(s) as may be necessary for the proper management and disposal of the firm.
  • No person shall be nominated administrator without his consent, but where such consent cannot be obtained, the applicant shall state that fact in the application for a practising certificate.
  • Where no person is nominated in the application for lack of consent or for any other reason, or where an administrator or administrators refuse(s) or neglect(s) to act, the Chairman of the Society shall make the nomination which shall for all intentions and purposes be as effectual as if made by the deceased or the incapacitated member.
